28.1  Right to Subcontract The District shall not contract out or subcontract services which are currently performed by unit members except in accordance with the following procedures:

28.1.1        Notification The District shall notify the Association no less than seventy (70) days prior to Board action regarding the subcontracting of any services currently provided by members of the unit.

28.1.2        Meet and Negotiate Subsequent to notification pursuant to 28.1.1, above, the District shall meet with the Association, upon request, to negotiate over the impact, if any, on unit members of subcontracting for services.

28.1.3        Layoff Notwithstanding the provisions of this Article, the District shall not enter into contracts with private vendors for services which would result in the layoff of certificated bargaining unit members as defined by Education Code Sections 44949 and 44955.
